Clarifications on European Court of Human Rights proceedings

• For case file 32345/22, payment was made on 27 October 2025

• For case file 40892/20, the plaintiff hasn’t yet presented the requested documents

• For case file 10558/21, the delays relate to entitlement of heirs

The delays cannot be imputed to the Portuguese Government

In the wake of recent news items on the enforcement status of three rulings from the Europea Court of Human Rights, the Ministry of Justice clarifies that all the relevant information was duly sent to the Council of Europe and the Court and that no delay can be imputed to the Portuguese State.

Case file 32345/22

The payment was pending only until the rectification of the ruling with regard to the plaintiff’s identification in the related case file 40799/22. This rectification was communicated on 18 September 2025, and payment was made on 27 October 2025, so there will be no interest on arrears as there is no delay to be imputed to national authorities.

Case file 40892/20

As for related case file 54252/20, the payment hasn’t yet been made because the plaintiff’s attorney hasn’t yet delivered the documents required to process the amounts, despite the Ministry of Justice Secretariat-General’s several requests. Payment will be made through the normal means once the documents are received.
